Crown Sydney VIP Casino Membership Policy

INTRODUCTION
1. Crown operates the VIP Casino pursuant to its Restricted Gaming Licence.

2.The VIP Casino is open to current VIP Casino Members and approved guests only.

3.This Policy is referred to as the Crown Sydney VIP Casino Membership Policy, and sets out the following policies relating to the VIP Casino:

3.1.VIP Casino Membership Policy, set out in Part 1 of this Policy;
3.2.VIP Casino Membership Review Policy, set out in Part 2 of this Policy; and
3.3.VIP Casino Guest Policy set out in Part 3 of this Policy.

4.This Policy incorporates the principles that have been agreed between Crown and the NSW Independent Casino Commission.

5.VIP Casino Membership and guest access to the VIP Casino is subject at all times to this Policy.

6.This Policy is not intended in any way to detract from Crown’s operating obligations as required by section 124 of the Act (Operating Obligations), which shall apply to the operation of this Policy, and prevail to the extent of any inconsistency.

7.Crown may amend the terms of this Policy from time to time, subject at all times to its Operating Obligations. Any amended Policy will be made available at crownsydney.com.au.

Definitions
In this Policy:

Act” means the Casino Control Act 1992 (NSW).

Crown” means Crown Sydney Gaming Pty Ltd.

Crown Group” means Crown Resorts Limited, any of its subsidiaries, and any other entity which the directors of Crown Resorts Limited are required to consolidate in the consolidated profit and loss accounts and balance sheets of Crown Resorts Limited under the Corporations Act 2001 (Cth).

Crown Management” means VIP Service Manager and above, Assistant Casino Manager and above, and above; and any other person determined by Crown from time to time.

Crown Rewards” means the customer loyalty program named Crown Rewards operated by Crown Melbourne Limited, Burswood Nominees Limited and Crown Sydney Gaming Pty Ltd.

Crown Rewards Membership Tier” means the level of Crown Rewards membership, based on the accumulation of Crown Rewards Status Credits during the relevant membership cycle period, determined by Crown from time to time in accordance with the Crown Rewards Rules and processes, which are currently:

10 Status Credits to attain Silver Crown Rewards Membership Tier;
35 Status Credits to attain Gold Crown Rewards Membership Tier;
150 Status Credits to attain Platinum Crown Rewards Membership Tier; and
Black Crown Rewards Membership Tier by invitation only at the discretion of Crown (which shall in all cases be greater than the requirements to attain Gold Crown Rewards Membership Tier).

Operating Obligations” has the meaning given to that term in Paragraph 6 of the Introduction to this Policy.

Policy” means this Crown Sydney VIP Casino Membership Policy.

Recognised Gaming Facility” means an Australian or international gaming facility recognised by Crown.

Recognised Gaming Facility VIP Tier Membership” means a current VIP tier membership of a Recognised Gaming Facility, as recognised by Crown.

Restricted Gaming Licence” means the Restricted Gaming Licence issued to Crown under the Act.

VIP Casino” means the boundaries of the Barangaroo Restricted Gaming Facility as defined under section 19A of the Act (other than back of house areas).

VIP Casino Member” means a person who has been granted VIP Casino Membership under the VIP Casino Membership Policy and who continues to remain a VIP Casino Member in accordance with the VIP Casino Membership Review Policy.

VIP Casino Membership” means membership entitling access to the VIP Casino in accordance with the VIP Casino Membership Policy and VIP Casino Membership Review Policy.

PART 1 - VIP CASINO MEMBERSHIP POLICY
This is the VIP Casino Membership Policy for the VIP Casino.

1.Applicants
a)Crown may grant VIP Casino Membership in accordance with this Policy at its sole discretion to those persons who satisfy the application process set out in section 2.

2.Application Process
This section 2 sets out the application process for VIP Casino Membership.

2.1.The applicant must:
a)be or become a Crown Rewards Member (other than international and interstate players participating in one of Crown’s rebate programs) by completing the Crown Rewards application process and supplying appropriate valid identification and information to the satisfaction of Crown;
b)apply for VIP Casino Membership by completing the VIP Casino Membership process;
c)consent to Crown collecting, recording, storing, using and disclosing their personal information (including image) for identification, security, probity, access, safety, and customer service purposes, including conducting a number of identification, security and probity checks as required by law, including Crown’s Operating Obligations;
d)acknowledge that the VIP Casino only offers higher limit gaming, does not offer poker machines and is not open to the general public of New South Wales; and
e)agree to comply with the dress standards and conditions of entry.

2.2.Crown will refuse the application, and cancel the VIP Casino Membership, of any person who:
a)is self-excluded, excluded or banned from any property in the Crown Group; or
b)through the requisite probity checks, is classified as not suitable for VIP Casino Membership.

2.3.Crown reserves the right to refuse an application or access of any person to the VIP Casino and/or revoke VIP Casino Membership at any time and for any reason.

2.4.Any VIP Casino Member wishing to cancel their VIP Casino Membership can do so by emailing their request to membership@crownsydney.com.au or by telephoning Crown’s VIP Services department (Cancellation Request). Crown will action all Cancellation Requests as soon as reasonably practicable after receipt of the Cancellation Request.

2.5.Any VIP Casino Member wishing to pause their VIP Casino Membership can do so by contacting Crown’s Responsible Gaming or VIP Services department (Pause Request). Crown will action all Pause Requests as soon as reasonably practicable after receipt of the Pause Request.

2.6.Crown Rewards membership is subject at all times to the Crown Rewards Rules.

3.NSW Residents
3.1.NSW residents (excluding those NSW residents who satisfy the requirements under section 4 below) will not be granted VIP Casino Membership until 24 hours after Crown's receipt of their membership application (i.e. a 24 hour “cooling off” period) (Cooling Off Period).

3.2.An applicant who wishes to withdraw their application during the Cooling Off Period can do so by emailing their request to rewards@crownsydney.com.au from the email address used in their application, or by telephoning Crown’s VIP Services department (NSW Resident Cooling Off Request). Crown will action all NSW Resident Cooling Off Requests within one business day of receipt of the NSW Resident Cooling Off Request.

3.3.Crown will notify the applicant when VIP Casino Membership has been granted.

4.NSW Residents Exempt from Cooling Off Period
4.1.A NSW resident who:
a) holds a current Recognised Gaming Facility VIP Tier Membership and produces evidence of such to the satisfaction of Crown; or
b) is granted VIP Casino Membership and has been identified by Crown as having gaming spend, while playing as a Guest at the VIP Casino under Part 3 of this Policy, equivalent to, or more than, the level required to attain Gold Crown Rewards Membership Tier at the time
will not be subject to the Cooling off Period.  

5.Access
5.1.Applicants for VIP Casino Membership who have satisfied the application process requirements of section 2 will only be granted VIP Casino Membership after:
a)the probity checks described in section 2.2 have been satisfactorily completed and Crown has made a determination, in accordance with its Operating Obligations, that the person may be granted VIP Casino Membership;
b)the applicant's name and details have been recorded by Crown; and
c)where applicable, the Cooling Off Period has expired and no NSW Resident Cooling Off Request has been received and actioned by Crown in accordance with section 3.2.

5.2.VIP Casino Members will be issued with a VIP Casino Membership card which must be presented on entry to the VIP Casino.

5.3.Appropriate identification to the satisfaction of Crown must be presented to replace any lost, damaged or destroyed VIP Casino Membership card.

5.4.Access to certain areas of the VIP Casino may be limited based on the VIP Casino Member’s assigned Crown Rewards Membership Tier level.

6.Records
6.1.Crown will maintain a database of VIP Casino Members, including those whose VIP Casino Membership has been cancelled and those who have been self-excluded, excluded or banned from Crown and relevant information may be disclosed to regulatory bodies as required by law.

PART 2 - VIP CASINO MEMBERSHIP RENEWAL POLICY
This is the VIP Casino Membership Renewal Policy for the VIP Casino.

1.1The VIP Casino Membership status of all VIP Casino Members will be reviewed by Crown in accordance with this VIP Casino Membership Renewal Policy as determined by Crown, no less frequently than annually. 

1.2VIP Casino Membership status will be assessed independently from Crown Rewards Membership status and Crown will consider the following factors in determining whether a VIP Casino Member shall retain their VIP Casino Membership until the next renewal period:
a)Frequency of visitation;
b)Average gaming spend per visit;
c)Average non-gaming spend per visit;
d)Annual gaming spend;
e)Annual non-gaming spend;
f)Place of residence;
g)Crown Rewards Membership Tier level;
h)Results of any probity checks undertaken by Crown in accordance with its Operating Obligations; and
i)Other relevant circumstances (e.g. ill health, overseas postings, gaming and non-gaming spend across the Crown Group, etc.) as determined by Crown.

1.3Due to their place of residence being outside New South Wales and the natural limitations this places on frequency of visitation and average and annual gaming and non-gaming spend, the VIP Casino Membership of international and interstate VIP Casino Members will renew each renewal period (subject to the relevant probity checks required by Crown’s Operating Obligations), provided they continue to reside outside New South Wales, unless otherwise determined by Crown.

1.4Notwithstanding the above renewal policy, Crown reserves the right to refuse or revoke entry and/or revoke VIP Casino Membership to the VIP Casino at any time and for any reason.

PART 3 - VIP CASINO GUEST POLICY
This is the VIP Casino Guest Policy for the VIP Casino.

1.Categories of Guests
a)Access to the VIP Casino as a guest will be offered to those persons in accordance with the following guest categories in this section 1 who satisfy the guest application process in section 2.
b)Approval of each guest is at the sole discretion of Crown.

1.1.Guests of VIP Casino Members
a)A VIP Casino Member may nominate up to three (3) persons at any one point to enter the VIP Casino as that VIP Casino Member’s guest. Crown may limit this number at any time.
b)Crown Management may permit additional persons be permitted entry as guests of that VIP Casino Member on special occasions (for example, the birthday of the hosting Member).
c)There is no limit to the number of visits a guest who is a spouse, partner or equivalent accompanying person of a VIP Casino Member (Spouse) may make.
d)A person who is not a VIP Casino Member (other than a Spouse) may be admitted as a guest of a particular VIP Casino Member up to 52 times within a 12-month period.  Any person who has reached their guest visitation limit will be directed by Crown Management to apply for VIP Casino Membership.
e)A guest of a VIP Casino Member will be granted access to the VIP Casino for the duration of their hosting VIP Casino Member’s visit. Where the hosting VIP Casino Member is on a rebate program, the guest will be granted access for the duration of their hosting VIP Casino Member’s program, but for no longer than 14 days from the date of registration. Any extension to the 14 day limit will require the approval of Crown Management.
f)A guest of a VIP Casino Member will be granted access to those areas of the VIP Casino commensurate with the access level of the VIP Casino Member.

1.2.Guests of Crown Management (Hotel)
a)All hotel guests of Crown may be granted access to the VIP Casino as a guest of Management.
b)A hotel guest may be granted access to the VIP Casino from 6am of the date of registration for their scheduled stay to 6am the day after check-out.
c)A hotel guest may be granted access to those areas of the VIP Casino as determined by Crown Management.

1.3.Guests of Crown Management (General)
a)Crown Management may, at their discretion, nominate international and interstate visitors to be granted temporary access as a guest of Crown Management to the VIP Casino.
b)There is no limit to the number of guests Crown Management may nominate.
c)A guest of Crown Management will be granted access for the duration determined by Crown Management.
d)A Guest of Crown Management will be granted access to those areas of the VIP Casino determined by Crown Management.

1.4.Guests of Directors
a)A Director of a company within the Crown Group may nominate a guest to be granted access to the VIP Casino.
b)There is no limit to the number of guests a Director may nominate.
c)A guest of a Director must have written approval from the Director passed on to Crown Management and sighted at the point of registration and visit creation. 
d)A guest of a Director will be granted access for the period determined by the Director or Crown Management.
e)A guest of a Director will be granted access to those areas of the VIP Casino determined by the Director or Crown Management.

2.Guest Application Process
2.1.Prior to accessing the VIP Casino, all Guests must apply to be a guest, including:
a)consenting to Crown collecting, recording, storing, using and disclosing their personal information (including image) for identification, security, probity, access, safety, and customer service purposes, including conducting a number of identification, security and probity checks as required by law, including Crown’s Operating Obligations;
b)acknowledging that the VIP Casino only offers higher limit gaming, does not offer poker machines and is not open to the general public of New South Wales;
c)confirming their acknowledgement to the terms and conditions of guest entry; and
d)agreeing to comply with the dress standards and conditions of entry.

2.2.Crown will refuse the application, and deny access to the VIP Casino, of any person who:
a)is self-excluded, excluded or banned from any property in the Crown Group; or
b)through the requisite probity checks, is classified as not suitable.

2.3.Crown reserves the right to refuse an application or access of any person to the VIP Casino at any time and for any reason.

3.Guest Access Process
3.1.Guests who have satisfied the requirements of section 2 will only be granted access to the VIP Casino as a guest after:
a)the probity checks described in section 2.2 have been satisfactorily completed and Crown has made a determination, in accordance with its Operating Obligations, that the person may be granted access to the VIP Casino; and
b)the applicant's name and personal details have been recorded by Crown.

3.2.Guests will be issued with a guest card which must be presented on entry to the VIP Casino.

4.Tours
4.1.For the avoidance of doubt, the Crown Group, including but not limited to Crown Management, any Directors within the Crown Group and Crown employees, may permit entry to the VIP Casino to any persons for purposes unrelated to gaming or entertainment (for example, for purposes of conducting tours), provided:
a)appropriate and valid identification is sighted;
b)those persons do not gamble;
c)those persons are in the company of a Crown employee at all times; and
d)the name, date of birth, and date of entry of each of those persons is recorded by Crown.
